FAILURE TO TAKE CHEMICAL TEST
§ 23577. Failure to Take a Chemical Test.
(a) If you are arrested for DUI and refuse to take or fail to complete a chemical test, the following penalties can be imposed:
(2) For felony DUI, jail time will be increased by 48 hours, regardless of whether or not you were granted probation.
(3) For first offense DUI, or second offense felony DUI, jail time will be increased by 96 hours, regardless of whether or not you were granted probation.
(4) For a fourth or more DUI conviction, jail time will be increased by 18 days, regardless of whether or not you were granted probation.
